The Malden Board of Health is a statutory board created pursuant to Massachusetts General Laws, Chapter 111, Section 26 and Chapter 41, Section 1. The office and its staff act for both the State and City to promote and protect the health, welfare and safety of Malden residents. The Board of Health leads the effort to improve the well-being of the community and enforces the laws and regulations governing health, environment, housing, and sanitation.

At a Board of Health Meeting held on May 16, 2019 and amended the Malden Board of Health Rules & Regulations, Section 21, Restricting the Sale and Use of Tobacco & Nicotine Delivery Products in the following way:
Section 21, Q, b, No permit holder shall sell, gift or distribute or cause to be sold , gifted or distributed any product containing cannabis or marijuana, as defined in 935 CMR 500.002, unless they are an approved Marijuana Establishment as regulated under 935 CMR 500.
Section 21, E.11.a, “At any given time, there shall be no more than 50 (fifty)Tobacco Product Sales Permits issued in Malden, reduced by the number of permits not renewed pursuant to subsection (b) below. No permit renewal will be denied based on the requirements of this subsection except any permit holder who has failed to renew his or her permit within thirty 30 days of expiration will be treated as a first-time permit applicant. “
Section 21, E.11.e, At any given time, of the allowed Permit number in subsection (a) above, there shall be no more than 4 (four) Tobacco Product Sales Permit issued to Adult – Only retail Tobacco Stores, per the definition, in Malden. No permit renewal will be denied based on the requirements of this subsection except any permit holder who has failed to renew his or her permit within thirty (30) days of expiration will be treated as a first-time applicant.”
